“Romania is in a place that is better than other countries and less good than it could have been. Here is my personal dissatisfaction: certainly, considering the resources we have, we could have been in a much better place. Unfortunately, incorrect governance over a long period of time \u2013 I could say even after the Revolution \u2013 has meant that for about 30 years we have missed few of the mistakes that we should have missed in this area” <\/p>\n\n

To this frustration of the energy industry was added that of consumers, whether household or non-household, in the conditions of rising prices. Or, says the president of the Romanian Energy Center, our country could have avoided reaching such a position. But the measures taken lately have not had a positive contribution. <\/p>\n\n

Energy legislation, amended 4 times in 10 months<\/strong><\/p>\n\n

What is the impact of Ordinance 119\/2022 on the energy sector? A major and negative one, says Corneliu Bodea, given that we have reached the fourth amendment in the last 10 months of the legislation by which consumers are protected against the increase in energy prices. And the fifth amendment is now under discussion in Parliament. <\/p>\n\n

“The impact also comes from this lack of predictability and coherence,” says the CEO of ADREM. “I would bring just one example: since August 31, since the appearance of this ordinance, the volume of energy traded on the Romanian markets is almost zero, almost zero. A lot of energy is still traded on the PZU market, which is the least suitable for such a thing. Large energy suppliers are in a situation where they no longer have contracted the volumes they should have contracted on this date, even for this winter. Which is why it is obvious that the impact of this legislation is major and unfortunately, not auspicious.” <\/p>\n\n

Overtaxing traders creates problems, instead of solving them<\/strong><\/p>\n\n

Another controversial provision of GEO 119\/2022 refers to the overtaxation of traders’ profits, which, say both analysts and market players, will most likely affect Romania’s ability to import gas.<\/p>\n\n

“I was extremely surprised that, although we have, as I said, 4 variants of this legislation, none of them except the last one addressed in any way the surcharge of traders. Suddenly, on September 1, the Government attacks this category of players head-on and extremely aggressively. Whether we love them or not, we must understand that traders play an essential role in the market balance. It is not something that we invented, it is not up to us to decide whether or not this free market component has the right to exist” <\/p>\n\n
